Surat: The Surat city police have named noted diamond businessman Vasant Gajera and four others in a land grabbing case. The other four are: Gajera’s brother Bakul Gajera, and three others — Aditya Hadakiya, Hiralal Hadakiya and Dharmesh Hapani.
The case was filed at Pal police station on Tuesday after the Supreme Court, on Feb 9, ordered for registration of an FIR.The main complainant in the case, an 82-year-old woman, had moved court after the district collector’s office had not heard her objections regarding forgery committed in a sale agreement.
According to police, the current market value of the land in question is Rs 90 crore. As the complainant, Laxmiben Jagjivandas Surti, belongs to the scheduled caste, the case has been transferred to the SC-ST cell of Surat city police.
In charge assistant commissioner of police (SC-ST cell), I N Parmar, said: “The five accused conspired to grab the heir property of the complainant and her relatives. The accused did a sale agreement with eight people after paying each of them Rs 11,111. The remaining amount was to be paid after conversion of the land into non-agricultural status and at the time of a sale deed.”
Parmar said the accused later changed the pages in the sale agreement and got a sale deed registered without the knowledge of the complainant and her relatives. He said they are investigating the case to find out who, apart from these five accused, are involved in the case.
The land in question is situated in Pal area under survey number 164 (3,339 square metres) and survey number 177 (3,642 square metres). The heir land belongs to Laxmiben and her seven relatives — Parvatiben, Ashokbhai, Veenaben, Satishbhai, Girishbhai, Dakshaben and Savitaben.
In 2012, accused Aditya and his father Hiralal gave Rs 11,111 to each of these eight owners and did a sale agreement. They told them that they would pay the remaining amount after the land was converted into non-agricultural status and when the sale deed was made.
However, later, the father-son duo changed some of the pages in the sale agreement and prepared a bogus sale agreement. Separately, they created a fake power of attorney that gave powers to Aditya to sell the land. This was done in 2012.
In the bogus sale agreement, it was mentioned that Rs 1.36 lakh was given in three instalments in 2010 and Rs 7.36 lakh in 2013 to Laxmiben and seven others. The agreement also mentioned a cheque payment of Rs 2.75 lakh and some cash payment.
On June 19, 2016, Aditya used the bogus power of attorney and forged sale agreement to execute a sale deed in the sub-registrar’s office in Rander. He registered the land in favour of Vasant Gajera, Bakul Gajera and Dharmesh Hapani.
At the time of this registration of the property, neither Laxmiben nor any of her seven relatives was present. When the family learnt about this, they raised the issue with the collector’s office but their objections were overlooked. The family then moved court.
